Rule 11 appointment

Good morning friends,
We have been appointed to represent a client under rule 11 (a) however the client had refused to engage with us. Should we ask to be appointed under Rule 11 (b) if the patient has been found to lack capacity or is the appointment under rule 11 a sufficient to proceed and act in the client’s best legal interests when addressing certain issues I.e request for a postponement? Thank you in advance

Sorry you’ve not had a reply yet. I think you should seek an appointment under rule 11(7)(b), unless you think the patient might engage with another solicitor.
