Where a client has been referred for a tribunal due to six months elapsing on section 3, but is put onto a CTO before the hearing date occurs, is it possible for the patient to request a paper hearing?
I am of course aware that where a CTO has been revoked, a referral made, and a further CTO put in place, then the paper hearing is an option via Form 128. Can this also be used for a section 3 to CTO case?

I do not believe it is for the patient to request a paper review, although they could request a Hospital Managers review at any time! The HM may then consider whether it is appropriate
My understanding is that any community case that is a referral can be disposed of on the papers by a single member as per Rules 4/5 of the amended TPR
