NR rights after patient released to care

Hi, I am new to the forum so I apologise if this has been covered.

My daughter has psychosis , first episode 2019 when she was living with me. Only help given to her is meds which she has on and off refused which led to hospitalisation twice.

I have made queries to MHT and my landlord on how to stop her being abusive at my house as she was living with a partner but comes here and shouts/verbally abuse I’ve/breaks thinks etc. I’ve tried to avoid a complete injunction as I still want to help her but my life is a misery.

The most recent hospital admission was in November on section 2. I gave past details and they said they would provide help such as housing/ assessment / support etc. The doctor was going to put her on a section three but it did not go ahead as the 2nd opinion dr. said that they couldn’t justify it. I agreed she could temporarily come to my address as she would have nowhere to go when section 2 ended which would mean she would have to stay in hospital.

Long story short, she came here with one weeks supply of medicine and was left without due to royal mess up with her mht team so did not have meds for 7 days. I have taken her for a follow up but there seems to be no support in place whatsoever and even less than before. She was previously on a depot injection but the have changed it to tablets which she hasn’t taken.

I feel like I have been conned by the mental health team as I know am in a worse situation as I am just sat in my house in fear, trying to tiptoe around in silence .she hadn’t hit me but she screams at the constantly with everything she has in her and throws things. I am also nervous because she screams through the wall at the neighbours because the voices she hears she believes are theirs . It has escalated previously to the point where the police have been called 4 times before hospitalisation due to the public and her safety.

I do need her to leave the house as I can not live like this and am constantly on edge. It is going on as I write this.

The police will call the mht and they have asked her to leave once but she comes back. They don’t give any legal instruction not to come back as she has mental health issues but that does not do anything for my situation.

Does anyone know how I would get her removed from my property? The landlord has suggested an injunction but that is not ideal. I feel like she should have had at least a few more weeks in hospital and that would have helped both of us but other than leaving my own house I don’t know what to do.

Do the mental health team have any responsibility being as it was them that released her here suggesting she was stable enough to come here?

Firstly, from what i gather your daughter has never been a s.3 MHA (1983) patient thus not entitled to s.117 aftercare.

Next, as the Nearest Relative you can request a mental health act assessment in your own right and the Local Authority needs to consider this. If they don’t proceed, you are entitled to know why in writing.

Now regarding accommodation, your daughter is entitled to a s.9 Care Act (2014) assessment to consider her accommodation needs etc. arising from her mental disorder.

Regarding Housing Legislation, she would be entitled to an assessment separate from the above Care Act.

If you ask her to leave even with Police enforcement since she is not on your tenancy. The Housing Department will have to provide 56 days worth of emergency accommodation. You are not doing any justice to your daughter or yourself in keeping her there.

Now for the CMHT, they are limited to 9 to 5 Mon to Fri and Crisis Team out of hours. Both the crisis team and Emergency Duty Service have funds to provide accommodation for a few days. So, ask them to consider your request.

You don’t elaborate on what the possible diagnosis is, and if it is exacerbated by drugs or alcohol or if it’s organic?

Thanks for your input. Her support with early interventions team knew that she could not stay here in 2021. They called shelter regarding local authority care and they told her to get a landlord place. It’s not the best advice as she would never be able to get that kind of money as she hasn’t worked since 2022. She would never be able to navigate a section 21 that seem to be given to lots of people lately.

She was living with an ex partner before hospitalisation and had been in touch with someone linked to the mental health team at the beginning of 2024 to get her out of there into housing/shelter. The person left and didn’t pass details over so nothing was ever done. I chased this in September and no one has got back to me.

I had spoken to lots of people regarding all this (over 8 hrs of calls) in the last few weeks. A social worker called to let me know she is likely to be put on a section 3 and said she sounds like she might be better in supported accommodation but as this didn’t go to section 3 I think they will leave that where it is.

I have applied to the local authority housing on her behalf but they have asked for evidence in the last 12 months of why she needs rehousing from a professional and not new evidence. I have no idea how I would access this.

The police removed her and she ended up in the middle of the city centre at night and she got jumped by two people because they thought she was shouting at them. The mht / police/ crisis team knew about this and the situation but it was still a week and a few more police visits before she was hospitalised and this was only because the paramedics called them .

She has developed a bit of an issue with drugs since 2021. This she says is due to the drugs(cocaine) is the only thing that keeps her head clear as she is no longer able to concentrate/watch tv/listen to music.

As for diagnosis, it’s just written as psychosis. She has never had any kind of assessment for other things . The doctor that saw her in the er said they could see parts of her coming through and there may have been a sign of some sort of mood disorder. The doctor army the ward was going to look into things such as bipolar etc but as she left this was not done.

On talking to a support worker at the ward they had enquired as to whether she had ever been assessed for autism . I was with her at the dr opa meeting and it was just a general “how are the meds” query. I had mentioned she had never received any help such as cbt etc and he wrote it down and said he would pass it to a manger. I don’t hold out much hope as I don’t know what kind of the communication /system s they use but it is completely horrendous and stressful and that is coming from someone with an admin job that has people shouting at them a lot . I don’t know how on earth someone who is ill would deal with this themselves and it horrifies me . I have more or less given up trying to get the mht to help as it’s almost impossible so looking at ways I can do as much as I can myself but niw, for myself also
