Looking for solicitor regarding 8 day CTO recall

My husband is looking for a solicitor to deal with a false imprisonment issue after an 8 day CTO recall. We are on a very low income and so would need a no win, no fee situation or legal aid (we have no idea what’s allowed). Can anyone recommend someone not too far from the Stoke-on-Trent area.

Any mental health law firm should be able to advise him. The Mental Health Lawyers Association has a geographical list (https://www.mhla.co.uk/find-a-lawyer/geographical-list/). The Law Society has a Find a Solicitor page (https://solicitors.lawsociety.org.uk/), though you need the advanced search form as “mental health” isn’t an option on the first form.

You’re right to worry about a recall that long, though maybe he agreed to remain informally or maybe his CTO was revoked. You might be interested in this topic: S3 assessment if a CTO recall lapses.

Thanks for that, we do have 3 CTO recall forms the 2nd starting the moment the 1st ended and the 3rd starting the 2nd ended. He certainly wasn’t staying voluntarily and was 80 miles from home. We approached the solicitor he had used for his Tribunals months ago but he never got back to us about this even though we did ask several times.

BTW if anyone within an hour of Stoke-on-Trent is interested in this case, please let me know. Seems that’s how close are nearest people are and we aren’t well enough to be calling round lots of places.

Are you saying that the recall has been done on a consecutive basis??? Can’t do that. The recall start the clock ticking for 72 hours and a decision re revoking the CTO, admission as informal or allowing the patient to go back on the CTO, has to happen within the time 72 hour limit. You need to ask the Hospital Managers on what basis is your husband being detained. Have you considered Nearest Relative discharge?

This was a few months ago, there was a recall started at 8:30am on the Wednesday, another at 8:30am on the Saturday and another at 8:30am Tuesday. He was finally released on the Thursday afternoon. My husband is now trying to find a solicitor who will help him get compensation for this unlawful detention.
