Level 1 fee for client who does not engage

Can we claim level 1 fee if we are appointed under Rule 11 7 A, we make an attempt to see the client on the ward, they do not wish to engage, and they are discharged the next day? We did contact the hospital following our visit on the same day to seek an MH3 to see if she had capacity and explain she did not engage with us during our visit. We don’t have much more on the file than that as she was discharged so quickly after our attempted visit.

Would we still have to wait the 2 months from sending the letter for billing even though the client was discharged?

As per 9.106 The Matter shall be considered at an end for the purposes of Paragraph 3.64(b) two months after you send the written letter described at Paragraph 9.105(c)(i).

No, I shouldn’t think so. I’d check with your contract manager for clarification though.
