My restricted client informs me that the MM advised her not to seek CD but instead to seek a recc for US leave. They also apparently suggested she ask MHT to discharge the s41 leaving her on a s37. Of course I don’t know whether they really said this but it seems unlikely that my client invented it. I planned to raise it as a prelim but the MM got the wrong day so the MHT was postponed. I don’t want the same MM on the reconvene so how should I raise this with the MHT?
You could just request a new medical member on a form CMR1, setting out what you have said here, and linking it with the overriding objective. It’ll be easier for them to agree to what you ask now than to go through the rigmarole of your review/appeal later.
