I am trying to find the details of an ongoing CoP case; I know the period in which the case was initially heard, but I have looked at the cases on the BAILII database within that time period, and I can’t find it - am I simply not searching correctly, or is there a better database I can use…? Is there a database specifically for CoP hearings…? Is BAILII the wrong database is what I’m asking.
I think the problem is that I don’t know the exact citation string; I know who P is, but I’m not sure of the body which instigated the proceedings (it could be one of two or possibly three).
To be clear, P is known to me and this is a case I have a vested interest in.
I’ve never had to do this before, so I don’t really know what I’m doing or where I should be looking.
One option would be using this Mental Capacity Cases | 39 Essex Chambers, and search using key words, cases are listed from most recent… So if the case involved social media, use that as the search term, so you may find it that way… There are probably other people on the forum who have other ideas, but if you could share year, name of LA / Trust (if that was made publicly available), name of judge, specific decision area/areas considered then i may be able to produce a list for you.
As I assume the case involves a specific LA or NHS Trust have you asked them? Alternatively have you thought about contacting Adult Social Care Court of Protection - contact details. Email: courtofprotectionenquiries@justice.gov.uk, Telephone: 0300 456 4600
