I have a H5 renewal where in part 3 the options deleted show that the RC furnished the report using the managers internal mail system but part 4 is ‘received by me on behalf of the hospital managers’. Does it make a difference if these dont match up?
Sorry you haven’t had a reply yet. Regulation 13(3) of the Mental Health (Hospital, Guardianship and Treatment) (England) Regulations 2008 just says:
The receipt of Form H5 shall be recorded by the managers of the hospital in which the patient is liable to be detained in the form set out in Part 4 of that Form.
The RC sent it on the date in Part 3 and the MHA Administrator (or whoever) received it on the date in Part 4. I don’t think it’s a problem.
