Please help
I was served with divorce papers whilst I had 3 hospital stays due to bipolar relapses. My ex sent me divorce papers via the kids, I was forced to sign a settlement figure if £10,000, we were married in community of property, they threatened me if I didn’t sign I would get nothing at all. During this time I was in a severe battle with my relapse. I have been out of hospital since January and this is bothering me that I was forced into signing the divorce. It will be 1 year in the 7th August since the divorce done online.
Hi Tracey. You’d be best consulting with a family law solicitor. Someone who lacks the capacity to make decisions around a divorce & accompanying financial settlement cannot lawfully consent to it (which sounds like what you’re alleging, but will depend heavily on the facts of your case). A family law specialist will be able to advise you if you have a remedy.
