Hi, I was accused of an offence, sent to prison for 3 Months, Then Mental Hospital. I was detained in Mental hospital based on my offence until my court hearing. I was found not guilty for my offence and further released from hospital on a CTO in the community. In my opinion there was absolutely Nothing wrong with me (Then or Now) other than being a bit upset and angry for a crime i know i did not commit, which was later proven. But that is a whole other story.
Whilst being on my CTO they tried to inject me with various medications in the community. I warned them that I wouldn’t take them and they threated to send me back to hospital if i didn’t take them whilst on my CTO. So I skipped the country not even in Europe, where they have no power over me. 6 months had passed and my I was told my CTO had expired. However, I was an Informal Patient and still under the care of the team and trying to say that If I ever need support , that they are here for me LOL. I made it clear to them that I never needed their support and I will not be engaging with them now or Never. And myself or nobody in my family ever agreed for them to make me an Informal Patient.
By UK Laws are they even allowed to do this without my consent. shouldn’t I be discharged?
What steps do I need to take now, to ensure when I do return. These people do not continue to harass me

Some teams do keep people on their caseload if they do not feel it is safe to medically discharge. I would ask why they have not discharged you, ask for this in writing, and if you do not agree, you can raise a complaint and escalate.
I have worked in teams where we have not discharged patients who are informal and requested discharge because we felt it was unsafe to do so. This was always in the context of the team decision being that a mental health act assessment is being sought as we felt treatment was needed. It does not sound like this is the case in your description, and if it is, they should make this clear to you. If they do not have a good reason to keep you under their caseload, they should discharge you as per your request. Do you have access to any advocacy?
If your CTO is expired, it cannot be renewed. You can only be put onto a CTO if you are re-admitted to hospital under S3 and a new CTO is applied for.
I am not legally trained but I do not think they have broken any law by not immediately discharging you from the team once a CTO expired.
Hi There, I completely understand what your saying. However, My question is, when my CTO expired. In order for them to make me an Informal Patient in the first place. They would need consent from myself, given the fact that I have not engaged with them for over 6 months and they have heard very little from my in person or over the phone. What right or Law allows them to make me an informal Patient without my Consent?
As you said you are not a lawyer so you may not know the answer to this question per say. However, you may still be able to answer this question to the best of your knowledge.
