— The Court of Appeal had to decide whether, in a trial of the facts conducted under s4A CPIA 1964 relating to an offence of possession with intent to supply a controlled drug contrary to section 5(3) of the Misuse of Drugs Act 1971, a jury is obliged to consider only whether the defendant was in possession of the drugs in question, or whether it must also consider whether the defendant intended to supply them.
