Capacity disputes

Hi.

Is anyone able to point me in the direction or guidance for dealing with capacity disputes. Particularly in instances whereby a s12 or BIA assesses P to have capacity to recieve care in the care home/hospital (or vice versa) , however a health or social care professional assesses otherwise in relation to a care and accommodation decision.
