Cases
- Case (Death). Hillingdon Hospitals NHS Foundation Trust v YD (Refusal of Withdrawal of Treatment) [2025] EWCOP 31 (T3) — The trust sought orders to permit them to withdraw CANH. This was opposed by the patient’s fiancée and partner (who had not known of each other’s existence before his hospitalisation) and the Official Solicitor. The judge concluded that it was in the patient’s best interests for CANH to continue, largely because of the patient’s past beliefs in spirituality etc.

T129. Form T129: Your rights to legal representation and to see the tribunal doctor (v04.25) — The Gov.uk update notes state: “Updated for legal accuracy. Added details of support and advice groups and made the guidance more accessible.” The form is still a PDF but the guidance is now in a separate HTML page (so in one sense less accessible) and the “Find a legal advisor” and “Citizens Advice” links do not work. Academic survey of hospital managers. Lancaster University, ‘Research study on associate hospital managers: Recruiting survey respondents now’ (23 July 2025) — Lancaster University are conducting a survey of those who sit on hospital managers’ panels, in England and Wales, and in the NHS and independent sector, as part of the “Searching for the Community in the Mental Health Act 1983 - Hospital Manager Panels, Local Justice and Legitimacy” project. The findings of the study will be published in academic journals and other publications, shared with policy makers, and used to inform the development of further research.

Event:Court of Protection User Group: Property and affairs ‘Town hall’ meeting (online, 24 September 2025) — This will be held online at 2pm. “The purpose of these meetings is to afford court users an opportunity to ask questions of resident judges as to court procedures and processes, on a non-case specific basis. Please be aware that we cannot answer policy-related questions. … You will not be able to speak in the meetings – participant microphones will be muted – but you will be able to submit supplementary questions via a ‘Q & A’ facility. The administrator of the webinar will triage the questions and the judges we will address as many of them as possible.” Email natalie.cheesewright@justice.gov.uk to register and (by 4pm on 15 September) to submit written questions.
